Multiple group home cases in various Superior Courts

Following the Attleboro Human Services victory, Attorney Margolin litigated a number of group home cases in other Massachusetts Superior Courts. All were successful and in each case, the trial judge adopted or expanded Judge Smith’s reasoning in the Attleboro case. Ultimately in 1977 and 1980, the Massachusetts Appeals and Supreme Judicial courts respectively, applied the Dover Amendment to staffed group homes for people with learning, emotional and developmental disabilities, thus securing the rights of people with serious disabilities to live in the community.
