Memorandum in Opposition to Proposed
The Department of Mental Retardation (now the Department of Developmental Services) proposed a policy requiring all non-profit corporations planning community group homes to notify neighbors before the home was open. The policy was contemplated after intense pressure from various neighborhood groups and state representatives uncomfortable with individuals with mental retardation living in their communities. Attorney Margolin was retained by the Massachusetts Council for Human Service Providers and the Massachusetts Association of 766 Approved Private Schools, to draft a memorandum of law explaining the illegality of the proposed policy and its violation of state and federal civil rights principles. The memorandum was sent to the Commissioner of the Department of Mental Retardation and the agency’s legal counsel. Following submission of the memorandum and a concerted effort by the Mass. Council and maaps, DMR permanently abandoned the planned "prior notification" policy.
